Terms of Service

Geographic scope. Plume Host offers its services to customers in the United States and Latin America. Our services are not directed to, and we do not actively solicit customers in, the European Economic Area, the United Kingdom, or Switzerland. If you access the site from those regions, we may decline to provide service.

These Terms of Service ("Terms") govern your access to and use of the services provided by Plume Host LLC, a Wyoming limited liability company ("Plume Host", "we", "us", "our"). By creating an account, placing an order, or using any of our services, you ("Customer", "you") agree to be bound by these Terms.

IMPORTANT — PLEASE READ: These Terms contain a binding arbitration agreement and a class-action waiver in Section 17 that affect how disputes between you and Plume Host are resolved. By accepting these Terms, you agree to those provisions unless you opt out as described in Section 17.6.

1. Services

Plume Host provides shared web hosting on cPanel infrastructure, related domain registration via third-party registrars, billing automation, and customer support. The exact features and resources of your plan are listed on the order page at the time of purchase and in your client area at management.plume.host.

2. Account Eligibility and Authority

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase a service. You must provide accurate, current, and complete account information and keep it updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

If you accept these Terms on behalf of an entity, you represent and warrant that you have the authority to bind that entity, and "you" and "Customer" refer to that entity.

3. Billing, Auto-Renewal, and Cancellation

4. Refunds

Refund eligibility is governed by our Refund Policy. In short: hosting plans are refundable within 30 days of initial purchase; renewals are non-refundable; domain registrations and add-ons are non-refundable once provisioned.

5. Acceptable Use

Your use of the services is subject to our Acceptable Use Policy. Violations may result in suspension or termination without refund. You are solely responsible for all content stored or transmitted through your account.

Where included, backups are provided as a courtesy and are not a substitute for your own backups. We do not guarantee the availability, completeness, or restorability of any backup. You are responsible for maintaining independent backups of your data.

8. Service Level

We target 99.9% uptime per calendar month, excluding scheduled maintenance and circumstances beyond our reasonable control. We do not offer service credits or financial compensation for downtime unless required by a separate signed agreement.

9. Customer Content and Data

You retain all rights to content you upload. You grant Plume Host a non-exclusive, limited license to host, transmit, and back up such content solely to provide the services. We do not access customer content except as needed to deliver, maintain, or troubleshoot the services, or as required by law.

10. Suspension and Termination

We may suspend or terminate your account, with or without notice, if you violate these Terms, the AUP, applicable law, or if your account creates risk or liability for us, other customers, or third parties. We may also terminate for non-payment after notice. Cancellation by you takes effect at the end of the current billing term unless an earlier date is requested.

11. Disclaimers

The services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the services will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our warranties are limited to the minimum required by law.

12. Limitation of Liability

Except for (a) breaches of confidentiality, (b) your indemnification obligations, (c) liability for death, personal injury, fraud, gross negligence, or willful misconduct, or (d) liability that cannot be excluded by applicable law, plume host's aggregate liability for any claim arising out of or relating to the services shall not exceed the greater of (i) USD 100 or (ii) the amounts you paid us in the twelve (12) months preceding the claim. plume host shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

13. Indemnification

You agree to defend, indemnify, and hold Plume Host harmless from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising from (a) your use of the services, (b) your content, (c) your violation of these Terms, the AUP, or applicable law, or (d) your violation of any third-party right. Plume Host will (i) promptly notify you of any indemnified claim, (ii) allow you to control the defense and settlement (provided settlement does not impose any non-monetary obligation on us), and (iii) reasonably cooperate at your expense.

14. Force Majeure

Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, government action, network or power outages, denial-of-service attacks, pandemic, or failure of upstream infrastructure providers.

15. Export Controls and Sanctions

You represent and warrant that (a) you are not located in, under the control of, or a national or resident of any U.S. embargoed country or region (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, Luhansk, Kherson, and Zaporizhzhia regions of Ukraine), and (b) you are not on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Denied Persons List or Entity List. You will not use the services in violation of any U.S. export control, sanctions, or anti-terrorism law.

16. DMCA / Copyright Complaints

Plume Host respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). Notices of claimed infringement must comply with 17 U.S.C. § 512(c)(3) and should be sent to our Designated Agent at hola@plume.host with the subject line "DMCA Notice". Our Designated Agent is registered with the U.S. Copyright Office and can also be reached at:

We will respond to valid notices, may remove or disable access to allegedly infringing material, and will terminate accounts of repeat infringers. If you believe material was removed in error, you may submit a counter-notification under 17 U.S.C. § 512(g) to the same address.

17. Dispute Resolution; Arbitration; Class-Action Waiver

17.1 Informal resolution. Before filing a formal claim, you agree to contact us at hola@plume.host and attempt to resolve the dispute informally for at least sixty (60) days.

17.2 Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the services (a "Dispute") that is not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. The arbitration shall take place in Casper, Wyoming, or by videoconference at your election. The arbitrator's award shall be final and enforceable in any court of competent jurisdiction.

17.3 Class-action waiver. You and Plume Host agree that any Dispute will be resolved only on an individual basis. Neither party may bring or participate in any class action, collective action, or representative proceeding, and the arbitrator may not consolidate more than one party's claims. If this waiver is held unenforceable, the entirety of Section 17.2 is void as to the affected claims.

17.4 Jury-trial waiver. You and Plume Host waive any right to a jury trial.

17.5 Small-claims carve-out. Either party may bring an individual claim in small-claims court located in Natrona County, Wyoming, or, for U.S. customers, in the small-claims court of the county where the customer resides, provided the claim qualifies.

17.6 Opt-out. You may opt out of arbitration by sending written notice to hola@plume.host with the subject "Arbitration Opt-Out" within thirty (30) days of your first acceptance of these Terms. If you opt out, Section 17 does not apply to you, but the rest of these Terms remain in effect.

17.7 Governing law. These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Natrona County, Wyoming, and you consent to personal jurisdiction there.

18. Notices

Notices to Plume Host must be sent to hola@plume.host and to Plume Host LLC, 5830 E 2nd St, Ste 7000 #35042, Casper, Wyoming 82609, United States. Notices to you will be sent to the email address on your account and are deemed received on the date sent.

19. Survival

Sections covering billing for services already rendered, customer content licenses, disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and any other provision that by its nature should survive, will survive termination of these Terms.

20. Assignment

You may not assign these Terms without our written consent. Plume Host may assign these Terms in connection with a merger, acquisition, reorganization, or sale of substantially all of its assets.

21. Entire Agreement; Severability; No Waiver

These Terms (together with the AUP, Privacy Policy, Refund Policy, and any order forms) constitute the entire agreement between you and Plume Host concerning the services. If any provision is held unenforceable, the remaining provisions remain in full effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable. No failure or delay in enforcing a right is a waiver of that right.

22. Third-Party Services

Our infrastructure is provided in part by Namecheap, Inc., and our software stack includes cPanel/WHM by cPanel, L.L.C., WHMCS by WHMCS Limited, and other third-party components. Your use of the services is also subject to the applicable terms of these providers.

23. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via the client area or by email at least thirty (30) days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
